Why no 3pm TV curfew in place?

I WAS surprised to see the FA Cup tie between Manchester City and Liverpool game live on BBC last Saturday.
I thought there was an agreement not to televise matches between 3pm and 5pm on Saturdays?
Thankfully, we still got over 450 for our match played at the same time.
